Knowable Education – Terms and Conditions of Use

These Terms and Conditions ("Terms") set out the legally binding agreement between you (whether a school, teacher, student or authorised user) and Knowable Ltd ("Knowable", "we", "us", or "our") in connection with your access to and use of our AI-powered marking platform and related services (the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. About Knowable

Knowable Ltd is a company registered in England and Wales (Company No. 15959421), with its registered office at 45 Fitzroy Street, London, W1T 6EB, United Kingdom. We provide automated grading, feedback, and reporting services for educational institutions through AI technologies.

2. Eligibility and Access

The Service is intended for use by educational institutions, their authorised staff, and students accessing the platform through school-managed accounts.

• Students under the age of 13 may only access the Service via their educational institution.
• Schools are responsible for obtaining any necessary parental or guardian consent, where required by applicable laws. We are committed to supporting schools in meeting these obligations and can provide guidance or resources to help facilitate the consent process.
• Schools and users must ensure all account details provided are accurate and kept up to date.

3. Acceptable Use

You agree to use the Service in a responsible, lawful, and educationally appropriate manner. You must not:

• Use the Service in any way that infringes upon the rights of others, including intellectual property, privacy, or contractual rights
• Attempt to access, interfere with, or manipulate any part of the Service or its data to which you are not authorised
• Upload or introduce any viruses, malware, or other harmful or disruptive code into the Service

You are responsible for maintaining the confidentiality and security of your login credentials. Any activity carried out through your account will be treated as your responsibility unless promptly reported as unauthorised.

4. Data Protection and Privacy

Our use of personal data is governed by our Privacy Policy, which forms part of these Terms.

• We collect and process data only as necessary to operate and improve the Service
• We act as a data processor for schools and data is only shared where legally justified
• We support schools in meeting their data protection responsibilities under UK GDPR and other applicable laws

5. Intellectual Property

All intellectual property rights in the Service, including its software, AI models, content, and branding, are and shall remain the exclusive property of Knowable or its licensors.

Users are granted a limited, non-exclusive, non-transferable, and revocable licence to access and use the Service solely for educational purposes. This licence may not be sublicensed or assigned.

You must not copy, modify, distribute, publicly display, or create derivative works based on any part of the Service without our prior written consent.

Nothing in these Terms grants or transfers any ownership rights in the Service.

6. Availability and Support

We aim to maintain reliable and continuous access to the Service. However, temporary disruptions may occur due to scheduled maintenance, software updates, or unexpected technical issues. Where feasible, schools will be notified in advance of any planned downtime.

We offer support to schools and authorised users via our helpdesk at [email protected]. While we aim to respond to queries within 48 hours, specific response times may vary. Where support issues relate to access, grading, or data, we treat them as priority cases.

7. Suspension and Termination

We reserve the right to suspend or terminate access to the Service where:

• A user or institution breaches these Terms: as determined by us in our sole discretion
• There is misuse or unauthorised access to the platform: that poses a risk to the Service or other users
• Required to do so by law or regulatory order: from a competent authority

Schools may also terminate access by written notice, subject to the terms of any applicable agreement.

Upon termination, access to user accounts and data may be restricted or deleted in line with our Data Retention Policy.

8. Security Measures

We take the security of personal data seriously and implement appropriate technical and organisational measures in line with UK GDPR standards. These measures include:

• Encryption of personal data in transit: using industry-standard protocols
• Role-based access controls: to ensure only authorised personnel can access sensitive information
• Logging and monitoring of system activity: to detect and respond to unauthorised access or misuse

We regularly review and update our security practices to reflect evolving threats and best practices in the education technology sector. While no system is completely immune to risk, we take all reasonable precautions to safeguard user data.

We encourage users to access the Service through secure, password-protected networks and to report any suspected security issues to our support team promptly.

9. Limitation of Liability

To the maximum extent permitted by law:

• Knowable shall not be liable for any indirect, incidental, or consequential damages: arising out of or in connection with the use of the Service
• Our total liability for any claims shall not exceed: the amount paid by the school or institution to Knowable in the twelve months preceding the incident

Nothing in these Terms limits liability for death, personal injury, or fraud.

10. Updates to Terms

We may amend these Terms from time to time to reflect changes in law, best practice, or Service updates. Where changes are material, we will notify affected users or institutions via the Service or registered email.

Your continued use of the Service after changes have been communicated will constitute acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and shall be interpreted in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
